In this respect and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to personal data processing and the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - hereafter “GDPR”), K-Drives a.s. notifies you regarding personal data processing and the rights connected thereto.
You hereby give consent to K-Drives a.s., company number: 41031130, with their registered office at Družstevní 20, 789 85 Mohelnice (hereafter only “Controller”), to process personal data, specifically, your email address.
It’s necessary to process your email address for sending commercial communications (newsletters). This information will be processed by the Controller when sending commercial communications, for which you have subscribed, however, this is for a maximum of 2 years.
You give your explicit and voluntary consent to the above-mentioned processing, which is the legal basis for processing according to Article 6 (1)(a) of the GDPR. You may withdraw consent to the processing at any time, however, the preceding processing is not affected. It’s also possible to withdraw your consent in any of the following ways:
directly from each of the commercial communications sent to you, in which you may select that you no longer want to be subscribed for commercial communication;
by sending a written withdrawal of your consent to the above-mentioned mailing address.
Based on the legal obligation or request, the personal data may also be transferred to third parties that have the legal authority to request the transfer of personal data in question.
K-Drives a.s. may transfer the provided personal data (in the above-mentioned extent) for the purpose of further personal data processing to other processors, who carry out the processing on the Controller’s behalf and who provide safeguards of appropriate and due processing and appropriate personal data protection, including their protection through appropriate technical and organisational measures against unauthorized or unlawful processing and against random loss, destruction or damage.
Personal data is processed using information technology, or manually regarding personal data in paper form. Both methods comply with all the security principles for the administration and processing of personal data according to the applicable legal regulations for personal data protection. For this purpose, the Controller has implemented appropriate technical and organisational measures which are reviewed and updated regularly.
You have the right to obtain confirmation as to whether or not your personal data is being processed, and, where that is the case, the right to access to that personal data and the information within the scope described in Article 15 of the GDPR, particularly information regarding the following:
the purpose of processing;
the category of personal data concerned;
the recipients or categories of recipients to whom the personal data has been or will be disclosed;
the envisaged period for which the personal data will be stored;
your rights in relation to personal data processing;
where personal data is not collected from you, any available information as to their source;
the existence of automated decision-making, including profiling;
Among others, you also have the following rights regarding personal data:
the right to obtain personal data rectification according to Article 16 of the GDPR, if we process inaccurate personal data concerning you, or where applicable, the right to complete the incomplete personal data;
the right to erase (“right to be forgotten”) and the Controller shall erase your personal data if the reason is given under Article 17 of the GDPR;
the right to restricted personal data processing according to Article 18 of the GDPR;
the right to personal data portability according to Article 20 of the GDPR;
the right to object to personal data processing according to Article 21 of the GDPR;
the right to refer to the supervisory authority (Personal Data Protection Office);
In the event where personal data processing is based on the given consent, you have the right to withdraw this consent at any time and therefore terminate processing.
When identifying that personal data has been violated or when there is a suspicion that personal data has been violated, the Controller assesses whether or not the personal data violation happened, evaluates its gravity (no risk, low risk, high risk) and depending on the gravity, informs you, as well as the supervisory authority (Personal Data Protection Office) regarding the personal data violation.
